BIA-Hawaii Welcomes the Passage of H.B. 830 Homeowner Exemptions

HONOLULU- The July 9, 2015 action of Governor Ige, signing into law H.B. 830, will help thousands of Hawaii’s homeowners. This law will exempt single-family homes and townhomes, 50+ years old, from mandatory review at the State Historic Preservation Division unless the home is on an historic register or nominated by their homeowner to be on an historic register.

Gladys Quinto Marrone, BIA-Hawaii CEO/ Chief Lobbyist, stated “BIA-Hawaii has been working on correcting this law that is well-intentioned, but results in unintended consequences. Before this law, every single building permit required on a home that is 50+ years was automatically routed to the State Historic Preservation Division (SHPD). These permits included Photo Voltaic permits, interior renovations and basic repairs.”

This law was intended to protect homes that are truly historic and architecturally worthy of preservation. However, due to the home that is 50+ years threshold, tract subdivision homes in Pearl City, Hawaii Kai, and soon, Mililani, would have been subjected to this additional review, which could not have compelled the homeowner to do anything since only the homeowner can voluntarily nominate their home to a SHPD register.

Gladys further stated, “This law, which was BIA’s top legislative priority, will not only help homeowners who want to make improvements to their home, this law will also help Hawaii’s construction industry.”

With the overall lack of supply of new housing units, renovation and remodeling work is being done in all neighborhoods across the state. Multi-generational housing is the new norm. Recognizing the need, our objective was to reduce the amount of time that a homeowner needed to wait to process their building permit for any remodeling or renovation work.
